Global E-Mail Policy

Terms Defined:

A global email will be defined as any email, or series of emails working in conjunction with one another, which possess a common substantive message, that is forwarded to the University of Miami’s School of law server based email community, in a quantity which is outlined below.

An author of an email is defined as any person, organization, or persons and organizations, working in conjunction with one another, whom forward an email to the law school’s server based email community.

Amount Of Emails Permissible To Law School Recipients By An Author

The amount of emails which a particular author can directly send to the University of Miami School of Law server based system, cannot be cannot exceed 150 recipients.

In the event that an organization’s member list exceeds the above referenced amount, that organization may be exempted from the rule by filing a request for an exemption to the Secretary of the Student Bar Association.

To Whom this Section Concerns:

This section applies to any individual, organization, or other such entity, sending email to the University of Miami School of Law’s server based community.

Authority to send Global Emails:

The authority to distribute global emails vests in the SBA President and shall be carried out by the SBA Secretary, or any designate of the SBA President.

Others authorized to distribute emails include, but are not limited to:

  1. The Student Webmaster of the University of Miami School of Law as appointed by the University pursuant the University Handbook.
  2. Select Deans, and Administrators.

Criteria Which Must Be Met in Order for a Global Email to be Forwarded to the Email Community:

In order for an organization to obtain clearance for global distribution, the following criteria must be met:

  1. The email message must contain a substantive base common to the entire law school community.
  2. Organizations may send out a maximum of 2 alert email messages for any single event.
  3. In the interest of recruiting, organizations may send out 2 global emails soliciting membership only during the first month of the fall and spring semesters.
  4. In the event an organization forms during the school year, that organization may send out a maximum of 2 global emails for the purpose of soliciting membership.

Fines:

In the event an organization, or series of organizations, working in conjunction with one another, is found in violation of the above, the following fines will be imposed:

  • First Violation: $25 fine.
  • Second Violation: $25 fine, and revocation of room privileges for two weeks.
  • Every other Violation: $50 fine, and revocation of room privileges for two weeks.

    An organization can pay a $25 fee to have their room privileges reinstated in the event where circumstances demand as such.

    The Authority To Levy Fines:

    The authority to levy fines vests in the President of the SBA as President of the ICC, and with the Secretary of the SBA as Chair of the ICC.

    Notice of fines must be presented in writing, as well as via email to the violator of the above policy. A copy of said fine must also be forwarded to the Dean of Students Office.

    Appeal to Fines:

    An organization wishing to file an appeal to a proposed fine must do so in writing, within ten days of receiving notice of the fine. The appeal will be heard by the Supreme Court of the SBA.

    Any levying of fines will toll until the Supreme Court issues its opinion.
